1. GENERAL PROVISIONS AND SELLER INFORMATION

1.1. These Terms and Conditions shall enter into force on the date of publication and set out the rules for using the online store available at https://alu-market.pl, placing orders, making payments, delivery, as well as the procedures for withdrawal from the contract and filing complaints within the territory of the European Union.

1.2. Sales are conducted in accordance with the laws of the Republic of Poland and the European Union, in particular the Act of 30 May 2014 on Consumer Rights (with particular regard to Chapter 5a concerning contracts obliging the transfer of ownership of goods), the Act of 23 April 1964 – Civil Code, EU Directive 2011/83/EU, and the GDPR Regulation.

1.3. Before placing an order, the Customer is required to read these Terms and Conditions. Acceptance of the Terms and Conditions is voluntary but necessary to complete the order.

2. BUSINESS PROFILE — NO CONSTRUCTION OR INSTALLATION SERVICES

2.1. The Alu-market.pl online store operates exclusively as a trading business engaged in the distribution and delivery of goods (aluminium profiles, security shutters, roller gates, transparent systems, and accessories).

2.2. The Seller does not provide on-site measurement services, assembly or installation services, maintenance inspections, or dismantling services.

2.3. The Buyer bears sole responsibility for the correctness and accuracy of the measurements taken, as well as for the proper installation carried out independently or by third-party companies engaged by the Buyer.

3. PRICES, PAYMENT METHODS AND REFUNDS

3.1. All prices presented on the website are gross prices expressed in Polish zloty (PLN) or euros (EUR) and include the applicable VAT.

3.2. The delivery cost is indicated in the shopping cart or agreed individually before the conclusion of the contract, depending on the type of goods, their dimensions, weight, and place of delivery.

3.3. Payment Methods: Payment for ordered goods is made in advance by traditional bank transfer to the Seller's bank account specified in the order summary and in the order confirmation e-mail.

3.4. Refund Policy: Refunds are made using the same payment method used by the Consumer (by bank transfer to the payer's bank account). The refund includes the price of the goods and the cost of the cheapest standard delivery method offered by the Store.

4. GOODS DELIVERY CONDITIONS WITHIN THE EU

4.1. Deliveries are made within the territory of the Republic of Poland and other European Union countries (including, but not limited to, Spain, Romania, and Germany) through specialized courier and transport companies.

4.2. The order processing time includes the time required to prepare/manufacture the goods and the time required for international delivery by the carrier.

5. RIGHT OF WITHDRAWAL FROM THE CONTRACT AND RETURNS

Pursuant to Article 38 of the Consumer Rights Act and EU Directive 2011/83/EU, the return rules differ depending on the nature of the goods:

5.1. Personalized and Made-to-Measure Goods (No Right of Withdrawal)

Pursuant to Article 38(3) of the Consumer Rights Act, the right to withdraw from a distance contract without giving a reason within 14 days DOES NOT APPLY to non-prefabricated goods manufactured according to the consumer's specifications or intended to meet the consumer's individualized needs (burglar-resistant shutters, security shutters, roller gates, polycarbonate shutters, and profiles cut to size).

Customer Rights and Individual Arrangements for Personalized Goods:

  1. Non-conformity of goods with the contract: In the event of manufacturing defects or non-conformity of personalized goods with the order, the Customer is entitled to remedies for non-conformity of the goods with the contract under the terms described in Section 6.
  2. Return by individual agreement between the parties: In exceptional circumstances (e.g. an incorrect measurement provided by the Customer before installation), the Seller may, upon the Buyer's written request, individually agree to accept the return or modify the goods. Each such case is considered individually and subject to an agreement between the parties.

5.2. Standard Stock Profiles and Accessories

  1. Right of withdrawal: A Consumer and an Entrepreneur with consumer rights within the EU have the right to withdraw from the contract without giving a reason within 14 days from the date on which the goods come into their possession.
  2. Refund: The Seller shall refund the payment promptly, and no later than 14 days from the date of receiving the withdrawal notice. The Seller may withhold the refund until the goods have been returned or the Consumer has provided proof of having sent the goods back, whichever occurs first. The refund includes the cost of the cheapest standard delivery method offered by the Store.
  3. Return shipping costs and oversized goods: The Buyer shall bear the direct costs of returning the shipment. In the case of oversized goods (e.g. uncut profiles of 2 m, 3 m or longer, or large-format sets) which, due to their nature, cannot be returned by standard postal services, the return shipping cost depends on the dimensions and weight of the shipment and the carrier selected. Such costs are determined in accordance with the current tariffs of courier or transport companies handling oversized and long-length shipments.

6. NON-CONFORMITY OF GOODS WITH THE CONTRACT (CONSUMER COMPLAINTS)

6.1. The Seller shall be liable to the Consumer for any lack of conformity of the goods with the contract pursuant to the provisions of the Consumer Rights Act (Article 43a et seq.). The Seller's liability for the lack of conformity of the goods with the contract shall last for 2 years from the date of delivery of the goods to the Consumer.

6.2. Complaint procedure and sequence of claims:

  1. If the goods are found to be non-conforming with the contract, the Consumer may first request that the goods be repaired or replaced.
  2. The Seller may replace the goods when the Consumer requests their repair, or repair the goods when the Consumer requests their replacement, if bringing the goods into conformity with the contract in the manner chosen by the Consumer is impossible or would require excessive costs.
  3. The Consumer may submit a statement requesting a price reduction or withdrawal from the contract if:
    1. The Seller has refused to repair or replace the goods or has failed to bring the goods into conformity with the contract;
    2. The lack of conformity of the goods with the contract continues despite the Seller's attempts to bring the goods into conformity;
    3. The lack of conformity of the goods with the contract is sufficiently significant to justify a price reduction or withdrawal from the contract without first exercising the right to repair or replacement;
    4. It is clear from the Seller's statement or the circumstances that the Seller will not bring the goods into conformity within a reasonable time or without causing excessive inconvenience to the Consumer.

6.3. The Seller shall review the complaint and provide a response within 14 days from the date of its receipt. Failure to respond within this period shall mean that the complaint is deemed accepted.

7. WARRANTY AND RECEIPT OF SHIPMENT

7.1. Warranty: If a manufacturer's or Seller's warranty is provided for a particular product (e.g. 12 or 24 months, as specified on the product page), its terms and duration are set out in the warranty document or product description. The warranty is an additional right and does not exclude, limit, or suspend the Consumer's rights arising from the statutory provisions on the non-conformity of goods with the contract.

7.2. Receipt of Shipment: It is recommended to carefully inspect the condition of the packaging and shipment in the presence of the courier. If any damage caused during transport is identified, preparing a Damage Report with the delivery person and notifying the Seller within 24–48 hours can significantly speed up the complaint handling process.

8. PERSONAL DATA PROTECTION (GDPR)

8.1. The data controller for the personal data of Customers throughout the EU is ALU-MARKET Sp. z o.o.

8.2. Personal data is processed solely for the purposes of processing orders, handling bank payments, issuing accounting documents, and handling complaints, in accordance with the website's Privacy Policy.

9. FINAL PROVISIONS, B2B AND ALTERNATIVE DISPUTE RESOLUTION (ADR)

9.1. With regard to Customers who are not Consumers (B2B / purchases made using a company NIP/VAT-EU number), statutory warranty liability (rękojmia) is excluded pursuant to Article 558 § 1 of the Civil Code.

9.2. Alternative Dispute Resolution (ADR): Consumers have the possibility to use out-of-court methods of handling complaints and pursuing claims. In particular, a Consumer may contact a municipal (district) Consumer Ombudsman or a Regional Inspectorate of the Trade Inspection in Poland, as well as the relevant ADR bodies in their country of residence within the EU.
