1. RIGHT TO WITHDRAW FROM THE CONTRACT (RETURNS)
Pursuant to Article 27 et seq. of the Polish Act of 30 May 2014 on Consumer Rights, the Consumer has the right to withdraw from a distance contract without giving any reason within 14 days from the date on which the Consumer took possession of the goods.
Exclusion of the Right of Withdrawal (Personalized and Cut-to-Size Goods):
Pursuant to Article 38 point 3 of the Act on Consumer Rights, the right to withdraw from the contract without giving any reason DOES NOT APPLY to goods that are not prefabricated and are manufactured according to the Consumer's specifications or serve to meet the Consumer's individualized needs. This applies in particular to: burglar-resistant and protective roller shutters, roller garage doors, polycarbonate roller shutters, and aluminum profiles cut to the dimensions specified by the customer.
2. PROCEDURE FOR RETURNING STANDARD GOODS
2.1. To exercise the right to return standard goods, the Consumer must inform the Seller of their decision by making an unequivocal statement (e.g. by sending a completed Withdrawal Form by e-mail or post).
2.2. The Consumer bears the direct costs of returning the goods (shipping the parcel back to the warehouse in Gdańsk).
2.3. The Seller shall refund the payment using the same payment method used for the original transaction (by bank transfer to the provided IBAN number) without undue delay and no later than 14 days from the date on which the Seller receives the withdrawal statement. The Seller may withhold the refund until the goods have been received or until the Consumer provides proof that the goods have been returned.
3. COMPLAINTS (NON-CONFORMITY OF GOODS WITH THE CONTRACT)
3.1. The Seller is liable to the Consumer for the lack of conformity of the goods with the contract pursuant to the provisions of the Act on Consumer Rights (Article 43a et seq.). This liability lasts for 2 years from the date of delivery of the goods.
3.2. In the event of manufacturing defects or damage (this also applies to personalized and cut-to-size goods), the Buyer has the right to submit a complaint and, in the first instance, request the repair or replacement of the goods with new goods.
3.3. Complaints should be submitted to the following e-mail address: profile@alu-market.com. The Seller will consider the complaint and provide a response within 14 days from the date of receipt.
